A new ruling has allowed French record companies to legally track P2P users sharing more than 50 files within a 24 hour period. The ruling also allows the companies to “keep their records for further legal proceedings” according to the country’s Council of State.In a brave protest so typifying the P2P file sharing community French file sharers have launched a program they call ‘51 fichiers’ – 51 files. This, they say, is in protest against the “systematic criminalisation of the Peer-to-peer networks and their users”. Users supporting the protest should share at least 51 files – all freely and legally distributable – and keep them on the P2P system until “something happens”. Obviously we nor they know what that ’something’ is. It will be interesting to find out.

Members of 51 Fichiers point out that most P2P file sharing applications can easily be configured to limit the number of shared files to any arbitrary number of the user’s choosing. 49 would be a good number, it points out: one below the published level at which ’something happens’.

Authorities have announced that a fairly limited set of 10,000 files would be the content upon which the auto-monitoring would be based. In terms of the number of distributed files ‘in the wild’, this represents only a small fraction and it is clear that only the most popular files could be monitored with any success.
